
Supreme Court: The Supreme Court said on Friday (March 17) during the hearing of a case that if the judiciary uses its powers to give land to lawyers to build chambers, then it will send a wrong message. The bench of CJI DY Chandrachud heard the petition filed by the Supreme Court Bar Association (SCBA). In fact, on this petition filed by SCBA president and senior advocate Vikas Singh, CJI Chandrachud said that instead of finding a judicial solution to the matter, the bar association should trust the court that the government will be discussed on this subject.
A bench of Justice Sanjay Kishan Kaul and Justice PS Narasimha said that lawyers are part of our institution. Should we use judicial orders to protect our community? It sends a very wrong message that the judiciary is using its powers to grab land. Today it is land, tomorrow it will be something else. It should not appear that the court is using its judicial powers in its own way. However, accepting the issue raised by the SCBA as correct, CJI Chandrachud said that it is not that we are not worried. We will talk to the government about this. Our needs are increasing and we can try to persuade them for our demands.
The solution will be found through administrative means only – Attorney General
Attorney General R Venkataraman said in the Supreme Court that the flexibility of the administrative process has a special advantage. We may lose in the court, but the conversation at the administrative level goes a long way. Senior advocate Vikas Singh said in the court that our only concern is that the matter should not be sidelined. The purpose of filing a petition is to start a conversation with the government. The Supreme Court said that the government takes our needs very carefully at the administrative level. Rs 7000 crore has been given to the Judiciary without any cut, because the Center felt that it was the need of the hour. These are the matters on which we should continuously engage with the government.
What is the matter?
In August 2022, the SCBA filed a petition in the Supreme Court seeking a direction to allot 1.33 acres of land to the Union Ministry of Urban Development for setting up lawyers’ chambers. Earlier this year on March 2, Vikas Singh appeared before the bench of CJI DY Chandrachud and complained about the non-hearing of the case despite being told several times. During this, senior advocate Singh had said in a loud voice that the demonstration of lawyers may start outside the house of the judges. On which the CJI had asked Singh to lower his voice and warned that such behavior will not work in the Supreme Court.
After this, senior advocates Kapil Sibal and Neeraj Kishan Kaul, who were present in the court, apologized to the CJI. After this, SCBA members moved a resolution demanding an apology from both the senior lawyers for diluting the case. On this matter, former Attorney General KK Venugopal said that the apology of senior lawyers was to maintain cordial relations. I request that resolutions against them should not be moved, which would increase the enmity between the two groups.
After the hearing on Friday, a letter of thanks was issued by the SCBA to the CJI for reserving the judgement. In which it was said that after waiting for 70 years, there is a big victory of the bar.
